OPEN FORUM
This is an opportunity for any citizen to briefly address the City Council on any matter that does not appear in this agenda.  Upon being recognized by the Mayor, please state your name, address, and limit your oral statement to no more than three minutes.  Matters that appear to warrant a more lengthy presentation or Council consideration will be agendized for further discussion at a later meeting.

CONSENT CALENDAR
The Consent Calendar consists of items that the City Council considers to be non-controversial.  Unless any item is specifically removed by any member of the City Council, staff, or audience, the Consent Calendar will be adopted by one motion.  Items removed will be considered in the sequence as they appear below.  If any member of the audience wishes to have an item removed, please step to the microphone, state your name, and indicate the item.

Item 6 was removed from the Consent Calendar by a member of the public for comment.

3.     Approve minutes of the July 13, 2015, regular City Council meeting.

4.     Approve warrants of July 2015.

5.     Adopt resolution designating signatories for the City of Belvedere’s WestAmerica Bank line of credit.

6.     Approve response to Marin County Civil Grand Jury Report, “The Need for Labor Negotiation Transparency.”

7.     Receive report from the Parks and Open Space Committee regarding update on donation opportunities in public areas within the City.

8.     Adopt resolution urging State to provide new sustainable funding for state and local transportation infrastructure.

Council discussed Item 6 and took public comment.

Motion: To accept proposed response to Grand Jury Report with change to Response #5

INDIVIDUAL CONSENT CALENDAR ITEMS
Individual Consent Calendar Items are considered non-controversial but require individual motions for approval due to necessary recusals.

9.    Approve revocable license for private improvements in the City right-of-way in front of 130 Bella Vista Avenue. Property Owner: James K. and Carmen D. Steil.

Motion: To approve the revocable license agreement for 130 Bella Vista Avenue for improvements in the street right-of-way with the condition that it does not remove any existing on-street parking

PUBLIC HEARINGS

10.    Introduction and first reading of an Ordinance amending Title 19, “Zoning,” of the Belvedere Municipal Code, proposed amendments to the 2030 City of Belvedere General Plan and an Initial Study/Negative Declaration to change the definition of height and height limits in the R1-L and R-2 zoning districts.
Staff recommendation: Conduct the public hearing and approve introduction of the ordinance.

8/7/2015 - Memo from Building Official/Flood Plain Administrator regarding benefits of floodplain freeboard requirements.

City Council conducted the public hearing.

Motion: To adopt a resolution approving the the Negative Declaration

Motion: To adopt a
resolution approving the proposed amendment to the 2030 City of Belvedere General Plan

Motion: To read the ordinance by title only to change the definition of height and height limits in the R1-L and R-2 zoning districts

OTHER SCHEDULED ITEMS

11.    Renewal of lease for Belvedere Community Center with the Belvedere-Tiburon Joint Recreation Department.
Staff recommendation: Approve the lease agreement.


Council requested more information on the financial details of the Belvedere-Tiburon Joint Recreation Department (The Ranch).

Motion: To continue the discussion on the lease agreement to the next regular meeting of the City Council in September

12.    Discussion on preliminary cost estimate for Beach Road Utility Undergrounding project.
Staff recommendation: Direct staff to include the Beach Road Utility Undergrounding in the Five-Year Capital Improvement Plan.


Council discussed the potential undergrounding project and directed staff to approach the four property owners in the area to determine their interest level.

13.    Assessment of flooding and drainage problems and conceptual remedies in area of Lagoon Road, San Rafael Avenue and Tiburon Boulevard.
Staff recommendation: (1) Request Town of Tiburon replace culvert under bike trail; (2) include project to replace culvert at San Rafael Avenue in the City’s Five-Year Capital Improvement Plan; and (3) require property owner at 6 San Rafael Avenue to maintain the creek bed free of debris and obstruction.


City Council discussed the report and received public comment. Mayor and Vice Mayor will approach the Town of Tiburon to come to an agreement on work to be done.
