The public will be given an opportunity speak on each agenda item when it is called.  Upon being recognized by the Mayor, please state your name and address, and limit your oral statement to no more than three minutes.  The Council welcomes comments and questions raised by interested citizens but typically does not respond during the comment period.

              Meeting was called to order at 6:33 PM.
                 
              Council Present: Donnell, McCaskill, Winter, and Mayor McAuliffe.
              Council Absent: Vice Mayo

 OPEN FORUM
This is an opportunity for any citizen to briefly address the City Council on any matter that does not appear in this agenda.  Upon being recognized by the Mayor, please state your name, address, and limit your oral statement to no more than three minutes.  Matters that appear to warrant a more lengthy presentation or Council consideration will be agendized for further discussion at a later meeting.

One speaker from the public discussed recent legislation on artificial turf and appeal deadlines perscribed by the Belvedere Municipal Code.


REPORTS & PRESENTATIONS

1.     City Council Reports.

Council Member Donnell and Mayor McAuliffe gave reports.

2.     City Manager Reports.

This item was heard later in the meeting.


 CONSENT CALENDAR
The Consent Calendar consists of items that the City Council considers to be non-controversial.  Unless any item is specifically removed by any member of the City Council, staff, or audience, the Consent Calendar will be adopted by one motion.  Items removed will be considered in the sequence as they appear below.  If any member of the audience wishes to have an item removed, please step to the microphone, state your name, and indicate the item.

Item 8 was removed from the Consent Calendar by a member of the Council for comment.

3.     Approve minutes of the September 14, 2015, regular City Council meeting.

4.     Approve warrants of September 2015.

5.     Adoption of an ordinance of the City of Belvedere amending Title 16, Buildings and Construction, and Title 20, Architectural and Environmental Design Review, of the Belvedere Municipal Code to implement programs to further enhance the already expedited building permit process for solar energy improvements and to demonstrate compliance with Assembly Bill 2188.

6.     Approve authorization of additional Property Assessed Clean Energy (PACE) financing programs to create Open PACE Marketplace.

7.     Amendment to City Manager Employment Agreement.

8.    Approve revocable license for private improvements in the City right-of-way in front of 105 Golden Gate Avenue. Property Owner: Tozzi Family Trust.

9.    Approve revocable license for private improvements in the City right-of-way in front of 26 Cove Road. Property Owner: Mary K. and Michael Brock.

The Council asked questions about the exhibit provided for Item 8.

Motion: To approve the revocable license for 105 Golden Gate Avenue.

 INDIVIDUAL CONSENT CALENDAR ITEMS
Individual Consent Calendar Items are considered non-controversial but require individual motions for approval due to necessary recusals.

10.    Approve revocable license for private improvements in the City right-of-way in front of 9 Fern Avenue. Property Owner: Beverly Savitt 2014 Trust.

Council Member Donnell recused herself because she owns property within 500 feet of the subject property.

The Council asked questions about the exhibit provided for Item 10.

Motion: To approve the revocable license for 9 Fern Avenue.

OTHER SCHEDULED ITEMS

11.    Revocable license for private improvements in the City street right-of-way in front of 130 Bella Vista Avenue. Property Owner: James K. and Carmen D. Steil. (Continued from September 14, 2015).
Staff recommendation: Reconsider the revocable license agreement for 130 Bella Vista Avenue in light of information presented that was not in the previous report.


Council continued this item to a future meeting. No one from the audience spoke.


The City Manager gave her report, which included possible discussion topics for the November City Council meeting.


12.    Discussion of costs to operate Belvedere Community Center (BCC) and consideration of terms of Amended and Restated Lease Agreement for BCC.  (Continued from September 14, 2015).
Staff recommendation: Consider lease terms and approve the Agreement with Belvedere-Tiburon Joint Recreation (BTJR) for Belvedere Community Center.

Council reviewed the Lease Agreement and discussed the ongoing transfer of operating costs of the Belvedere Community Center to the Belvedere-Tiburon Joint Recreation Committee (BTJRC).

An ad hoc committee of Council Members Donnell and McCaskill was formed to further investigate opportunities balance the subsidy that the City offers BTJRC.

Motion: To approve the Lease Agreement of the Belvedere Community Center with BTJRC for a two-year term ending December 2016.
