ANNOTATED AMENDED AGENDA - REGULAR MEETING
BELVEDERE CITY COUNCIL

 COMMENTS ON AGENDA ITEMS BY MEMBERS OF THE PUBLIC

The public will be given an opportunity speak on each agenda item when it is called.  Upon being recognized by the Mayor, please state your name and address, and limit your oral statement to no more than three minutes.  The Council welcomes comments and questions raised by interested citizens but typically does not respond during the comment period.



5:30 PM     CALL TO ORDER IN CONFERENCE ROOM I


              Meeting was called to order at 5:30 PM and adjourned to closed session.

              Council Present: Campbell, Donnell, McCaskill, Winter, and Mayor McAuliffe
              Staff Present: City Manager Neilan



 CLOSED SESSION

1.     CONFERENCE WITH LABOR NEGOTIATOR

Unrepresented and represented employees: All City employees
The closed session is for a review of the City Council’s position and to instruct the City’s designated representative, City Manager Mary Neilan, regarding salaries and/or compensation paid in the form of fringe benefits to members of the Belvedere Police Officers Association and to unrepresented City employees. Closed session permitted pursuant to § 54957.6(a) of the California Government Code.

6:30 PM     RECONVENE IN OPEN SESSION IN COUNCIL CHAMBERS
                    PLEDGE OF ALLEGIANCE


             Meeting was reconvened in the Council Chambers at 6:33 PM.  Building Official
             Banvard, City Planner Borba, Public Works Manager Derdenger, Finance
             Director Eastman, City Clerk Foulis, Deputy City Attorney Longfellow, Associate
             Planner Markwick, and Chief Seyler joined the meeting.


            
Mayor McAuliffe announced that no reportable actions were taken in the closed
             session.


            
Mayor McAuliffe lead the Pledge of Allegiance.


 OPEN FORUM
This is an opportunity for any citizen to briefly address the City Council on any matter that does not appear in this agenda.  Upon being recognized by the Mayor, please state your name, address, and limit your oral statement to no more than three minutes.  Matters that appear to warrant a more lengthy presentation or Council consideration will be agendized for further discussion at a later meeting.

REPORTS & PRESENTATIONS

2.     Presentation of Executive Certificate to Police Chief Patricia Seyler by Bob Stresak, Executive Director of the Commission on Peace Officer Standards and Training (POST).

Chief Seyler was presented with an Executive Certificate.

3.     2016 Belvedere Concerts-in-the-Park funding request.

Council directed staff to include funding for Belvedere Concerts-in-the-Park in next year's budget.

4.     City Council Reports.

Council Members Donnell and McCaskill gave reports.

5.     City Manager Reports.

City Manager Neilan reported on the new Automated License Plate Reader signage and the upcoming slurry seal project.

6.     Presentation by Phil Smith, Marin-Sonoma Mosquito and Vector Control District Manager, on “The Emergence of Zika Virus in the Americas and What this Means for California.”

MSMVCD Manager Phil Smith gave his presentation and answered questions from the Council.


 CONSENT CALENDAR
The Consent Calendar consists of items that the City Council considers to be non-controversial.  Unless any item is specifically removed by any member of the City Council, staff, or audience, the Consent Calendar will be adopted by one motion.  Items removed will be considered in the sequence as they appear below.  If any member of the audience wishes to have an item removed, please step to the microphone, state your name, and indicate the item.

Council Member Donnell stated that she must abstain from Item 7 as she was not present for the meeting. Mayor McAuliffe asked questions about the warrants for March 2016 (Item 8) and the cost to provide fire protection services (Item 9).

To approve Items 3, 5, and 6 as part of the Consent Calendar

By McCaskill, second by Campbell; approval unanimous (Donnell abstained
                   from Item 7)

7.     Approve minutes of the March 14, 2016, regular City Council meeting.

8.    
Approve warrants of March 2016.

9.     Declare the cost to provide fire protection and emergency services in Fiscal Year 2016-2017 will exceed $450,000.

10.     Approve response to Marin County Civil Grand Jury Report, “2015-16 Web Transparency Report Card: Bringing Marin County’s Local Governments to Light.”

11.    Award of construction contract for the 2016 Slurry Seal Project to Pavement Coatings Company, the lowest responsive bidder.


 INDIVIDUAL CONSENT CALENDAR

Vice Mayor Campbell recused himself for Item 12 and Item 13. Council Member Donnell recused herself for this item.

Mayor McAuliffe asked questions about the proposed exhibit.

Motion:  To approve the revocable license for 142 Bella Vista Avenue.

By McCaskill, second by Winter; approval unanimous (Campbell and Donnell
              recused)


12.    Revocable license for private improvements in the public right-of-way behind 142 Bella Vista Avenue. Property Owner: Thomas E. and Angela M. Graf.


OTHER SCHEDULED ITEMS

13.    Revocable license for private improvements in the City street right-of-way in front of 130 Bella Vista Avenue. Property Owner: James K. and Carmen D. Steil. (Continued from October 12, 2015.)
Staff recommendation: Reconsider the revocable license agreement for 130 Bella Vista Avenue.

The Council considered the revised revocable license agreement and continued the item to a future meeting pending further revisions to the fence location.

14.   
Discussion on possible changes to Belvedere Municipal Code Chapter 8.18, “Smoking and Tobacco Regulations.”
Staff recommendation: Discuss inte
rest in making changes to Belvedere Municipal Code Chapter 8.18 and provide direction to staff on certain policy decisions.


The Council requested more information be heard from Bob Curry, Marin County Tobacco Related Disease Control Program, and requested Staff reach out to the Belvedere Land Company for comment before proceeding with an ordinance.
