ANNOTATED AGENDA - REGULAR MEETING

6:30 PM     CALL TO ORDER
                    PLEDGE OF ALLEGIANCE


              Meeting was called to order at 6:30 PM.
                 
              Council Present: Campbell, Donnell, McCaskill, Winter, and Mayor McAuliffe.
              Council Absent: None.


              Mayor McAuliffe led the Pledge of Allegiance



 OPEN FORUM
This is an opportunity for any citizen to briefly address the City Council on any matter that does not appear in this agenda.  Upon being recognized by the Mayor, please state your name, address, and limit your oral statement to no more than three minutes.  Matters that appear to warrant a more lengthy presentation or Council consideration will be agendized for further discussion at a later meeting.

REPORTS & PRESENTATIONS

1.     Spotlight Award presentation to Sallie Griffith for Excellence in Community Service.

The Spotlight Award was presented to Sallie Griffith.

2.     City Council Reports.

Council Member Winter gave a report on the Richardson Bay Regional Agency (RBRA).

3.     City Manager Reports.

City Manager had no reports.


 CONSENT CALENDAR
The Consent Calendar consists of items that the City Council considers to be non-controversial.  Unless any item is specifically removed by any member of the City Council, staff, or audience, the Consent Calendar will be adopted by one motion.  Items removed will be considered in the sequence as they appear below.  If any member of the audience wishes to have an item removed, please step to the microphone, state your name, and indicate the item.

The entire consent calendar was approved in one motion by the City Council.

4.     Approve minutes of the May 9, 2016, regular City Council meeting.

5.    
Approve warrants of May 2016.

6.    
Adopt two resolutions for the period of July 1, 2016, through June 30, 2018, establishing salaries and benefits for Miscellaneous Employees and ratifying a memorandum of understanding between the City and the Belvedere Peace Officers Association establishing salaries and benefits for those personnel.

7.    
Approve response to Marin County Civil Grand Jury Report, “Police Firearm Security: Keeping Police Guns out of the Hands of Criminals.”

8.    
Adopt a resolution authorizing the Mayor to sign the Joint Powers Agreement for Hazardous Materials Spills Management.

9.    
Approve amendment to the Joint Powers Agreement for the Belvedere-Tiburon Library.

10.   
Approve amendment to the legal services agreement with Epstein Law Firm.

11.   
Adopt a resolution approving the Belvedere Land Company, Lower Beach Road Subdivision – Planned Unit Development Final Map and eleven revocable licenses for improvements in the public right-of-way in front of various subdivision lots and accepting related quitclaim deed.

12.    Accept completion of the Lower Golden Gate Avenue Pavement Repair Project.

13.   
Accept completion of the 2016 Slurry Seal Project.



PUBLIC HEARINGS

14.    Consider resolution levying a special tax for fire and emergency medical services and fixing the rates thereof for the Fiscal Year 2016-2017.
Staff recommendation: Conduct
the public hearing and thereafter adopt resolution establishing the assessment.


City Council conducted the Public Hearing and there were no comments from the Public.

15.    Consider resolution approving the City of Belvedere Annual Operating and Capital Budget for Fiscal Year 2016-2017 and the Five-Year Capital Plan.
Staff recommenda
tion: Conduct the public hearing and thereafter adopt the resolution appropriating funds for the 2016-2017 Fiscal Year.


City Council conducted the Public Hearing; there was one comment from the public.
The Council approved a $10,000 donation to help fund the Trestle Trail project in Tiburon and passed a resolution adopting the FY2016-17 Annual Operating Budget and Five-Year Capital Plan.

16.    Consider resolution amending the City of Belvedere Master Schedule of Fees, Charges, and Application Fees.
Staff recommendation: A
dopt resolution approving revised Master Schedule.


City Council conducted the Public Hearing and there were no comments from the Public.

17.    Introduction and first reading of an ordinance amending the Belvedere Municipal Code, Section 20.04.035, “Time limits for construction,” increasing the Construction Time Limit daily fine amounts and the maximum fine amount, and incorporating minor administrative updates. (Continued from March 14, 2016.)
Staff recommendation
: Conduct the public hearing and approve the introduction of the ordinance.

The Council approved reading the ordinance by title only and approved the first reading of the ordinance.

18.    Introduction and first reading of an ordinance amending the Belvedere Municipal Code, Title 11, “Water and Watercraft,” to require boat permits, establish a fee for boat permits, and provide a penalty for any boat in Belvedere waters without a permit in excess of 10 hours; clarify the City’s authority to remove derelict boats pursuant to existing state law; remove Chapter 11.12 to prohibit houseboats; and other minor administrative updates.

ct the public hearing and approve the introduction of the ordinance.


City Council conducted the Public Hearing and there were no comments from the Public.
The Council approved reading the ordinance by title only and approved the first reading of the ordinance including a change to proposed subsection 11.05.010(F) in order to designate all penalty monies to be deposited into the City's General Fund rather than a separate City fund.


19.    Introduction and first reading of an ordinance amending the Belvedere Municipal Code, Title 19, “Zoning,” to establish a permit process, procedures, and standards for review and approval of Junior Second Units in existing single family dwellings.
Staff recommendation: Conduct the
public hearing and approve the introduction of the ordinance.

The Council approved reading the ordinance by title only and approved the first reading of the ordinance.


OTHER SCHEDULED ITEMS

20.    Issuance of revenue bonds by the Belvedere Public Financing Authority to refund outstanding undergrounding assessment bonds in the City to provide savings to property owners.

tion: Adopt to associated resolutions.

No comments were made by the public. The Council approved three resolutions relating the refinancing of outstanding undergrounding assessment bonds in the City.

The Council adjourned at 8:14 PM to conduct a meeting of the Belvedere Public Financing Authority.

8:00       ADJOURN TO CONDUCT THE MEETING OF THE BELVEDERE PUBLIC FINANCING
              AUTHORITY

          The meeting of the Belvedere Public Financing Authoritywas called to order
          at 8:14 PM. All members of the Board of the Belvedere Public Financing
          Authority were present and no one from the public wished to speak during the
          open forum.

          No one from the public wished to comment on the first item, and the Board of
          the Belvedere Public Financing Authority passed a resolution relating to the
          refinancing of outstanding undergrounding assessment bonds in the City.

          The meeting of the Belvedere Public Financing Authority adjourned at 8:15 PM.

8:05       RECONVENE REGULAR COUNCIL MEETING IN COUNCIL CHAMBERS

The Council reconvened at 8:15 PM in the Council Chambers.

21.    Consider setting a special City Council meeting to hear a presentation from White Buffalo, Inc.; consider adopting a resolution authorizing an application to the California Department of Fish and Wildlife for a permit to conduct a deer sterilization research project; and discussion of next steps.

cil meeting for July 27, 2016, consider adoption of a resolution authorizing application for a permit for Ca. Dept. of Fish and Wildlife, and discuss next steps.

Staff presented the staff report and answered questions from the Council. The Council listened to public comment from 17 speakers.

The Council did not approve a resolution allowing White Buffalo, Inc. to apply for a permit with the Department of Fish and Wildlife on behalf of the City for deer sterilization, and instead approved a motion 4-1 (Winter opposed to proceeding with the project) to direct Staff to gather further information on the population numbers and status of the existing deer population in Belvedere from an unbiased source. The Council agreed to hold a special meeting on July 27, 2016, to hear further information and public comment, as well as a presentation from vendor White Buffalo, Inc. if the company is available to attend without cost to the City.

22.    Consider request from the Belvedere Concerts-in-the-Park Committee to hold a special event during evening hours on September 3, 2016, for a movie night event at Belvedere Community Park, including the use of amplified sound. (Continued from May 9, 2016.)
Staff recommendation: Consider special even
t application from the Concerts-in-the-Park Committee.

The Council heard public comment from 5 speakers and then voted to approve the special event permit application from the Belvedere Concerts-in-the-Park Committee to hold a movie-night event at Community Park during evening hours, including the use of amplified sound.

23.    Consider request from Belvedere-Tiburon Joint Recreation (The Ranch) to hold a special event during evening hours on October 22, 2016, at Belvedere Community Park for a movie night event, including the use of amplified sound. (Continued from May 9, 2016.)
Staff recommendation: Consi
der special event application and request for financial support from Belvedere-Tiburon Joint Recreation.

The Council heard public comment from 1 speaker and then voted 3-2 (Campbell and Donnell opposed) to approve a one-time special event permit application from The Ranch hold a Halloween movie-night event at Community Park during evening hours, including the use of amplified sound. The Council continued the discussion on The Ranch's budget request for a $2,000 contribution to the event in order to allow The Ranch to solicit contributions from local businesses and community members first.

24.    Consider appointments to various City committees and commissions.
Staff recommendation: Make appointm
ents to various City committees and commissions.

The Council motioned to make the suggested appointments and reappointments to the various Committees and Commissions in the City of Belvedere.

The meeting was adjourned at 10:25 PM.
