ANNOTATED AGENDA - REGULAR MEETING
BELVEDERE CITY COUNCIL

 COMMENTS ON AGENDA ITEMS BY MEMBERS OF THE PUBLIC

The public will be given an opportunity speak on each agenda item when it is called.  Upon being recognized by the Mayor, please state your name and address, and limit your oral statement to no more than three minutes.  The Council welcomes comments and questions raised by interested citizens but typically does not respond during the comment period.


6:30 PM     CALL TO ORDER
                    PLEDGE OF ALLEGIANCE


              Meeting was called to order at 6:31 PM.
                 
              Council Present: Kemnitzer, McAuliffe, McCaskill, Winter, and Mayor Campbell
              Council Absent: None


              Mayor Campbell led the Pledge of Allegiance.

1.     Interview applicants for the various positions on City committees.
Council interviewed two candidates for the position on the Parks and Open Space Committee.


 OPEN FORUM
This is an opportunity for any citizen to briefly address the City Council on any matter that does not appear in this agenda.  Upon being recognized by the Mayor, please state your name, address, and limit your oral statement to no more than three minutes.  Matters that appear to warrant a more lengthy presentation or Council consideration will be agendized for further discussion at a later meeting.

REPORTS & PRESENTATIONS

2.     City Council Reports.
Council Members McCaskill, Kemnitzer, Campbell, and McAuliffe gave reports.

3.     City Manager Reports.
City Manager had no reports.


 CONSENT CALENDAR
The Consent Calendar consists of items that the City Council considers to be non-controversial.  Unless any item is specifically removed by any member of the City Council, staff, or audience, the Consent Calendar will be adopted by one motion.  Items removed will be considered in the sequence as they appear below.  If any member of the audience wishes to have an item removed, please step to the microphone, state your name, and indicate the item.

4.     Approve minutes of the July 11, 2016, regular City Council meeting. - Approved minutes.

5.     Approve warrants of July 2016.- Approved warrants.

6.     Approve response to Marin County Civil Grand Jury report, “The 911 First Responder Program: More Than a Band-Aid for Seniors.”- Approved Grand Jury response.

7.     Approve response to Marin County Civil Grand Jury report, “Law Enforcement Complaint Procedures: The Grand Jury Has a Few Complaints.” - Approved Grand Jury response.

8.      Adopt resolution approving amendments to the City of Belvedere Conflict of Interest Code. - Approved Conflict of Interest code amendments.

9.      Approve extension of moratorium on the installation of memorial benches as recommended by the Parks and Open Space Committee. - Approved extension.

10.    Revocable license for private improvements in the public right-of-way in front of 82 Alcatraz Avenue. Property Owner: Irene M. Myers Trust dated October 24, 2005. - Approved revocable license.

11.    Revocable license for private improvements in the public right-of-way in front of 431 Golden Gate Avenue. Property Owner: The Miller and Applewhite Revocable Trust. - Pulled from Consent Calendar to discuss wire fencing. Approved revocable license.

12.    Revocable license for private improvements in the public right-of-way in front of 222 San Rafael Avenue. Property Owner: The Hawthorne Revocable Trust.
- Approved revocable license.


OTHER SCHEDULED ITEMS

13.      Consider proposal to conduct deer population count and suggestion to hold a community meeting on the topic of deer.
Staff recommendation: Consider proposal from Dr. Benjamin Stacks to conduct a fecal DNA mark-recapture project in Belvedere and consider scheduling a community meeting in early September.
Staff presented the staff report and answered questions from the Council. The Council listened to public comment from 22 speakers.

The Council unanimously approved a motion to not undertake a study of the deer population at this time. The Council unanimously approved a motion to schedule a community meeting for a date to be determined likely in October 2016 to discuss the deer. Staff was directed to invite various experts in their field to the meeting, and the public was encouraged to submit names of experts they would like to attend as well.


14.      Consider exempting Junior Second Units from the municipal Fire Service Tax.
Staff recommendation: Provide direction to Staff.

Council directed staff to draft an ordinance exempting Junior Second Units from the municipal fire service tax.

15.      Consider adopting gun safety measures in Belvedere.
Staff recommendation: Provide direction to Staff.

Council directed staff to draft an ordinance incorporating only the amendments to the Municipal Code regulating handgun storage. There were two speakers from the public.

16.      Discuss Council assignments to various city, county, and regional boards and committees.
Staff recommendation: That the City Council discuss the list of their appointments and make changes as they see fit.

Council discussed their appointments and made changes as necessary.

17.      Consider appointment to various positions on City committees and commissions.
Staff recommendation: Discuss applicants and make appropriate appointments.

Council appointed Bryan Kemnitzer to the open position on the Parks and Open Space Committee and directed staff to discuss the open position on the Belvedere-Tiburon Joint Recreation Committee with the other applicant.
