ANNOTATED AGENDA - REGULAR MEETING

The public will be given an opportunity speak on each agenda item when it is called.  Upon being recognized by the Mayor, please state your name and address, and limit your oral statement to no more than three minutes.  The Council welcomes comments and questions raised by interested citizens but typically does not respond during the comment period.


6:30 PM     CALL TO ORDER
                    PLEDGE OF ALLEGIANCE


              Meeting was called to order at 6:30 PM.
                 
              Council Present: Kemnitzer, McAuliffe, McCaskill, Winter, and Mayor Campbell
              Council Absent: None


              Mayor Campbell led the Pledge of Allegiance.


 OPEN FORUM
This is an opportunity for any citizen to briefly address the City Council on any matter that does not appear in this agenda.  Upon being recognized by the Mayor, please state your name, address, and limit your oral statement to no more than three minutes.  Matters that appear to warrant a more lengthy presentation or Council consideration will be agendized for further discussion at a later meeting.

REPORTS & PRESENTATIONS

1.     City Council reports.
No City Council reports.

2.     City Manager reports.
The City Manager reported that a Grant Agreement for the Ca. Dept. of Water Resources Local Levee Assistance Program was received and is being reviewed. Approval of this agreement is the final step in award of a $611,000 grant for evaluation of the San Rafael Avenue and Beach Road seawalls.

3.     Police Chief reports.
        A.       Tiburon Fire Protection District’s Diamond Jubilee Parade scheduled for Saturday, October 1, 2016.
The Police Chief reported on the parade.


 CONSENT CALENDAR
The Consent Calendar consists of items that the City Council considers to be non-controversial.  Unless any item is specifically removed by any member of the City Council, staff, or audience, the Consent Calendar will be adopted by one motion.  Items removed will be considered in the sequence as they appear below.  If any member of the audience wishes to have an item removed, please step to the microphone, state your name, and indicate the item.

4.     Approve minutes of the August 8, 2016, regular City Council meeting. - Approved minutes.

5.    
Approve warrants of August 2016. - Approved warrants.

6.    
Adopt resolution adopting the 2016-17 Fiscal Year Gann Appropriations Limit for the City of Belvedere. - Adopted resolution.

7.    
Adopt a resolution declaring October 1, 2016, and the first Saturday of October in future years to be “Bay Day” to celebrate, protect, and restore San Francisco Bay. - Adopted resolution.

8.    
Approve revocable license for private improvements in the public right-of-way in front of 49/51 Alcatraz Avenue. Property Owner: The Alan E. Steier Revocable Trust U/D/T Dated December 23, 1992 and The Bonnie Sudler Revocable Trust U/D/T Dated December 23, 1992.
- Approved revocable license.


PUBLIC HEARINGS

9.    Introduction and first reading of an ordinance amending the Belvedere Municipal Code Chapter 8.18, “Smoking and Tobacco Regulations,” and presentation by Bob Curry, Marin County Department of Health and Human Services – Tobacco Related Disease Control Program.
Staff recommendation: Hear presentation from Mr. Curry and then conduct the public hearing and approve the introduction of the ordinance; waive future reading of the ordinance in its entirety.
Bob Curry, Marin County Dept. of Health and Human Services, gave a presentation to the Council on the benefits of adopting a revised smoking ordinance.

The Council conducted the public hearing (1 speaker from the public) and unanimously approved introduction and first reading of the ordinance.


10.   
Introduction and first reading of an ordinance amending the Belvedere Municipal Code Title 9, “Public Peace, Morals, and Welfare,” to add a new chapter regulating handgun storage requirements.
Staff recommendation: Conduct the public hearing and approve the introduction of the ordinance; waive future reading of the ordinance in its
entirety.

The Council conducted the public hearing (0 speakers from the public) and unanimously approved introduction and first reading of the ordinance.

11.   
Introduction and first reading of an ordinance amending the Belvedere Municipal Code to exempt Junior Second Units from the municipal fire service tax.
Staff recommendation: Conduct the
public hearing and approve the introduction of the ordinance; waive future reading of the ordinance in its entirety.

The Council conducted the public hearing (1 speaker from the public) and unanimously approved introduction and first reading of the ordinance.


OTHER SCHEDULED ITEMS

12.    Consider plans for Community Forum on Deer.
Staff recommendation: Consider plans f
or Community Forum on Deer, confirm date and participants.

Staff presented the staff report and answered questions from the Council. The Council listened to public comment from 9 speakers.

The Council agreed to hold the Community Forum on Deer on Wednesday, October 26, 2016 at 6:00 PM.


13.   
Budget amendment request for City’s Annual Holiday Volunteer Party.
Staff recommendation: Consider allo
cating additional funds for the City’s Annual Holiday Volunteer Party.

The Council unanimously approved a motion to allocate an additional $4,500 for the City's Annual Holiday Volunteer Party and agreed to discuss possible changes to the event after the first of the year.

14.   
Discuss researching into the Sister City/Friendship City program.
Staff recommendation: Authorize
Mayor Campbell to form a committee to explore opportunities for a Sister City/Friendship City relationship.

The Council unanimously approved a motion to authorize Mayor Campbell to form a committee to explore opportunities for a Sister City or Friendship City relationship.
