ANNOTATED AGENDA - REGULAR MEETING
BELVEDERE CITY COUNCIL

 COMMENTS ON AGENDA ITEMS BY MEMBERS OF THE PUBLIC

The public will be given an opportunity speak on each agenda item when it is called.  Upon being recognized by the Mayor, please state your name and address, and limit your oral statement to no more than three minutes.  The Council welcomes comments and questions raised by interested citizens but typically does not respond during the comment period.



5:00 PM     CALL TO ORDER IN CONFERENCE ROOM I
                    ADJOURN TO CLOSED SESSION


              Meeting was called to order at 5:00 PM and adjourned to closed session.

              Council Present: Kemnitzer, McAuliffe, McCaskill, and Mayor Campbell
              Staff Present: Interim City Manager Pollard and Heather Renschler, Ralph
              Andersen and Associates.

6:30 PM     RECONVENE IN OPEN SESSION IN COUNCIL CHAMBERS
                    PLEDGE OF ALLEGIANCE


             Meeting was reconvened in the Council Chambers at 6:30 PM.
         
             Mayor Campbell lead the Pledge of Allegiance.
Mayor Campbell announced that
             no reportable actions were taken in the closed session.



 OPEN FORUM
This is an opportunity for any citizen to briefly address the City Council on any matter that does not appear in this agenda.  Upon being recognized by the Mayor, please state your name, address, and limit your oral statement to no more than three minutes.  Matters that appear to warrant a more lengthy presentation or Council consideration will be agendized for further discussion at a later meeting.


REPORTS & PRESENTATIONS

2.     Spotlight Award presentation to Janet Andersen for Excellence in Community Service.

3.     2014 Annual Greenhouse Gas Emissions Inventory report by Christine O'Rourke, Climate Action Director at the Marin Climate and Energy Partnership.
Christine O'Rourke, Marin Climate and Energy Partnership, presented a community report on Belvedere's 2014 Annual Green House Gas Emissions.

4.     City Council Reports.
Council Member McCaskill and McAuliffe and Mayor Campbell gave reports.

5.     City Manager Reports.
Interim City Manager Pollard reported that the February 27, 2017, community forum on deer in Belvedere had been deferred.


 CONSENT CALENDAR
The Consent Calendar consists of items that the City Council considers to be non-controversial.  Unless any item is specifically removed by any member of the City Council, staff, or audience, the Consent Calendar will be adopted by one motion.  Items removed will be considered in the sequence as they appear below.  If any member of the audience wishes to have an item removed, please step to the microphone, state your name, and indicate the item.

The Consent Calendar was approved in one motion:

6.     Approve minutes of the January 23, 2017, special City Council meeting.- Approved minutes.

7.     Approve warrants of January 2017. - Approved warrants.

8.     Accept annual audit for the City of Belvedere.
- Accepted audit.


PUBLIC HEARINGS

9.    Appeal of a Planning Commission decision made on December 20, 2016, to approve Design Review and Exception to Total Floor Area for an addition to the existing residence for the property located at 1 West Shore Road. Appellants: Neil and Beth Cherry. Property Owner: PEEK Development LLC, Peter Mark.
Staff recommendation: That the City Council deny the appeal and uphold the decision of the Planning Commission.

The Council conducted the public hearing and unanimously approved a resolution denying the appeal.


OTHER SCHEDULED ITEMS

10.    Receive written protest received for notice of nonrenewal of Mills Act Agreement issued for 450 Belvedere Avenue and consider revoking the notice of nonrenewal. Property Owners: Meehan Revocable Trust et al.
Staff recommendation: Review the written protest
of notice of nonrenewal submitted by the property owners of 450 Belvedere Avenue and decide whether to keep the notice of nonrenewal in effect, revoke it, or request further information.

The Council determined to take no action, thereby keeping the notice of nonrenewal in effect. The property will enter the ten-year phase out period of the Mills Act Agreement.

11.   
Receive written protest received for notice of nonrenewal of Mills Act Agreement issued for 296 Beach Road and consider revoking the notice of nonrenewal. Property Owners: Emory Williams and Jie Liu.
Staff recommendation: Review the written pro
test of notice of nonrenewal submitted by the property owners of 296 Beach Road and decide whether to keep the notice of nonrenewal in effect, revoke it, or request further information.

The Council determined to take no action, thereby keeping the notice of nonrenewal in effect. The property will enter the ten-year phase out period of the Mills Act Agreement.

12.   
Formation of a subcommittee to review the City’s annual volunteer holiday party logistics.
Staff recommendation: Select two Council M
embers to serve on a subcommittee to review the procedures for the annual volunteer holiday party with staff.

Vice Mayor Winter and Council Member McAuliffe were selected to serve as the holiday party reviewing subcommittee. Council Member McCaskill was chosen as an alternate should Vice Mayor Winter be unable to participate.

The meeting was adjourned at 8:18 pm.
