ANNOTATED AGENDA - REGULAR MEETING

 COMMENTS ON AGENDA ITEMS BY MEMBERS OF THE PUBLIC

The public will be given an opportunity speak on each agenda item when it is called.  Upon being recognized by the Mayor, please state your name and address, and limit your oral statement to no more than three minutes.  The Council welcomes comments and questions raised by interested citizens but typically does not respond during the comment period.


6:30 PM     CALL TO ORDER
                    PLEDGE OF ALLEGIANCE


Meeting was called to order at 6:30 PM.

Council Present: Campbell, Kemnitzer, McCaskill, and Mayor Winter
Council Absent: McAuliffe

Mayor Winter led the Pledge of Allegiance.


 OPEN FORUM
This is an opportunity for any citizen to briefly address the City Council on any matter that does not appear in this agenda.  Upon being recognized by the Mayor, please state your name, address, and limit your oral statement to no more than three minutes.  Matters that appear to warrant a more lengthy presentation or Council consideration will be agendized for further discussion at a later meeting.


REPORTS & PRESENTATIONS

1.     City Council Reports.
Council Members Winter and McCaskill gave reports.

2.     City Manager Reports.
City Manager Middleton gave a report.


 CONSENT CALENDAR
The Consent Calendar consists of items that the City Council considers to be non-controversial.  Unless any item is specifically removed by any member of the City Council, staff, or audience, the Consent Calendar will be adopted by one motion.  Items removed will be considered in the sequence as they appear below.  If any member of the audience wishes to have an item removed, please step to the microphone, state your name, and indicate the item.

The Consent Calendar was approved in one motion:

3.     Approve minutes of the July 10, 2017, regular City Council meeting. - minutes approved.

4.    
Approve warrants of July 2017. - warrants approved.

5.    
Adoption of an ordinance of the City of Belvedere amending Title 19, “Zoning,” of the Belvedere Municipal Code regarding Accessory Dwelling Units and Junior Accessory Dwelling Units. - ordinance adopted.

6.    
Approve response to Marin County Civil Grand Jury Report, “The Budget Squeeze: How Will Marin Fund Its Public Employee Pensions?” - response approved.

7.    
Approve response to Marin County Civil Grand Jury Report, “Public Engagement in Marin: A Pathway to Inclusive Governance.” - response approved.

8.    
Designate a Director and Alternate Director to represent the City on the Public Agency Risk Sharing Authority of California (PARSAC)’s Board of Directors. - resolution adopted.

9.     Award contract for the 2017 Slurry Seal Project to California Pavement Maintenance Company, Inc, the lowest responsible bidder. - contract awarded.

10.   
Approve revocable license for private improvements in the public right-of-way in front of 20 Lagoon Road. Property Owner: The William B. Matthews Revocable Trust U/A January 5, 2015. - revocable license approved.

 INDIVIDUAL CONSENT CALENDAR ITEMS
Individual Consent Calendar Items are considered non-controversial but require individual motions for approval due to necessary recusals.

11.    Approve revocable license for private improvements in the public right-of-way in front of 270 Beach Road. Property Owner: James Haynes and Hollie Moore Haynes.  - revocable license approved.

12.   
Approve revocable license for private improvements in the public right-of-way in front of 14 Eucalyptus Road. Property Owner: The Shih-Wei Peng and Diana I.L. Peng Living Trust. - revocable license approved.


OTHER SCHEDULED ITEMS

13.    Consider pre-funding a portion of the City’s unfunded pension liabilities.
Staff recommendation: Adopt resolution authorizin
g and directing the execution of lease financing documents related to the refinancing of a portion ($2.6 million) of the City’s current unfunded pension liability with CalPERS.

             FINANCING AUTHORITY

6:45     RECONVENE REGULAR COUNCIL MEETING IN COUNCIL CHAMBERS


The City Council and the Public Financing Authority approved resolutions authorizing and directing the execution of lease financing documents related to the refinancing of the City's current unfunded pension liabilities.



PUBLIC HEARINGS

14.    Appeal of a Planning Commission decision made on June 20, 2017, to approve a fence ranging in height between four and eight feet at the North property line for the property located at 36 Cove Road. Appellant: Rob & Constance Peirce. Property Owner: Rob & Constance Peirce.
Staff recommendation: That the City Council conduct the public hearing and either deny the appeal and uphold the decision of the Planning
Commission or consider the revised plans submitted August 1, 2017, and approve the appeal granting Design Review and a Variance to construct a fence ranging in height between four to nine feet at the North property line.

The appeal of Planning Commission decision regarding 36 Cove Road was unanimously denied. The alternative design submitted by the Appellant/Property Owner on August 1, 2017, was also denied (3-1, McCaskill opposed).
