The public will be given an opportunity speak on each agenda item when it is called.  Upon being recognized by the Mayor, please state your name and address, and limit your oral statement to no more than three minutes.  The Council welcomes comments and questions raised by interested citizens but typically does not respond during the comment period.


6:30 PM     CALL TO ORDER
                    PLEDGE OF ALLEGIANCE


Meeting was called to order at 6:30 PM.

Council Present: Campbell, Kemnitzer, McAuliffe, McCaskill, and Mayor Winter
Council Absent: None

Mayor Winter led the Pledge of Allegiance.



 OPEN FORUM
This is an opportunity for any citizen to briefly address the City Council on any matter that does not appear in this agenda.  Upon being recognized by the Mayor, please state your name, address, and limit your oral statement to no more than three minutes.  Matters that appear to warrant a more lengthy presentation or Council consideration will be agendized for further discussion at a later meeting.

REPORTS & PRESENTATIONS

1.     City Council Reports.
Council Member Kemnitzer and Mayor Winter provided reports.

2.     City Manager Report.
City Manager Middleton provided a report.


 CONSENT CALENDAR
The Consent Calendar consists of items that the City Council considers to be non-controversial.  Unless any item is specifically removed by any member of the City Council, staff, or audience, the Consent Calendar will be adopted by one motion.  Items removed will be considered in the sequence as they appear below.  If any member of the audience wishes to have an item removed, please step to the microphone, state your name, and indicate the item.

The Consent Calendar was approved in one motion:

3.     Approve minutes of the August 14, 2017, regular City Council meeting. - minutes approved.

4.    
Approve warrants of August 2017. - warrants approved.

5.    
Authorize the City Manager to execute a Memorandum of Understanding with the County of Marin regarding the development of improvements at the Tiburon Boulevard (Highway 131) and US 101 interchange. - City Manager authorized to sign MOU.

6.    
Approve revocable license for private improvements in the public right-of-way in front of 287 Bayview Avenue (Accessory Dwelling Unit of 236 Bella Vista Avenue). Property Owner: Ghazaleh Jamei and Houman Sharif.  - revocable license approved.


 INDIVIDUAL CONSENT CALENDAR ITEMS
Individual Consent Calendar Items are considered non-controversial but require individual motions for approval due to necessary recusals.

7.    Approve revocable license for private improvements in the public right-of-way in front of 49 Peninsula Road. Property Owner: Mordechai and Barbara Winter Revocable Trust.  - revocable license approved.


PUBLIC HEARINGS

8.       Appeal of a Planning Commission decision made on June 20, 2017, to approve Demolition, Lot Merger, Design Review, Exception to Total Floor Area, Variance(s), Use Permit, Accessory Dwelling Unit (2nd Unit), Extension of the Construction Time Limit and Revocable License requests to demolish an existing residence and construct a new residence and second unit for the property located 135 Belvedere Avenue. Appellant: INJ LLC and its Managing Agent Anthony Piazza. Property Owner: Amalfi 135 Belvedere, LLC.
Staff recommendation: That the City Council grant the appeal with conditions in part with respect to Design Review approval and deny the appeal and confirm the d
ecision of the Planning Commission with respect to the CEQA Mitigated Negative Declaration, Demolition Permit, Lot Merger approval, Exception to Total Floor Area, Variance(s), Use Permit, and Accessory Dwelling Unit requests for the property located at 135 Belvedere Avenue.

City Council granted the appeal in part with respect to Design Review and denied the appeal and confirmed the decision of the Planning Commission with respect to CEQA Mitigated Negative Declaration, Demolition Permit, Lot Merger approval, Exception to Total Floor Area, Variance(s), Use Permit, and Accessory Dwelling Unit.


9.      Appeal of a Planning Commission decision made on August 15, 2017, to approve the final landscaping plan, lighting, walls/fences and exterior amenities for the property located at 339 Golden Gate Avenue. Appellant: Carmen & Thomas Freiburger and Cathy Steck. Property Owner: Golden Gate Belvedere, LLC.
Staff recommendation: That the City Council deny the appeal and uphold the decision of the Planning Commission.

City Council denied the appeal and upheld the decision of the Planning Commission, except with respect to requiring the removal of the fence and gate across Eucalyptus Lane (an unimproved City lane) and requiring that the proposed brownstone wall does not encroach into the Golden Gate Avenue right-of-way. (Ayes: Campbell, McAuliffe and Mayor Winter; Noes: Kemnitzer and McCaskill)


10.    Appeal of a Planning Commission decision made on August 15, 2017, to approve Demolition, Design Review, Exception to Total Floor Area, a Variance and Revocable License applications to build a new single family home and attached carport for the property located at 1 Belvedere Avenue. Appellant: Daniel Ruark. Property Owner: Susan C Kelly Revocable Trust.
Staff recommendation: That the City Council deny the appeal and uphold the decision of the Planning Commission.

City Council denied the appeal and upheld the decision of the Planning Commission, finding that the property at 1 Belvedere Avenue is not an historic resource.


OTHER SCHEDULED ITEMS

11.    Consider request from Belvedere-Tiburon Joint Recreation (The Ranch) to hold a special event at Belvedere Community Park during the evening hours on October 21, 2017, for a movie night event, including the use of amplified sound; and request for financial support.
Staff recommendation: Consider special eve
nt application and request for financial support from Belvedere-Tiburon Joint Recreation (The Ranch).

City Council approved the special event permit application and a financial contribution of $1,500 for Belvedere-Tiburon Joint Recreation's Boo Bash event on October 21, 2017.


12.   
Appoint members of the City Council to serve as liaisons and voting members of various local and regional committees, boards, and joint powers agencies.
Staff reco
mmendation: That the City Council discuss the list of their appointments and make changes as they see fit.

City Council reviewed their appointments and kept their various assignments as is.
