 COMMENTS ON AGENDA ITEMS BY MEMBERS OF THE PUBLIC

The public will be given an opportunity speak on each agenda item when it is called.  Upon being recognized by the Mayor, please state your name and address, and limit your oral statement to no more than three minutes.  The Council welcomes comments and questions raised by interested citizens but typically does not respond during the comment period.


6:30 PM     CALL TO ORDER
                    PLEDGE OF ALLEGIANCE

1.      Interview applicants for various positions on City committees and commissions.
The Council interviewed Ms. Diana Bradley for the open position on the Marin County Commission on Aging.


 OPEN FORUM
This is an opportunity for any citizen to briefly address the City Council on any matter that does not appear in this agenda.  Upon being recognized by the Mayor, please state your name, address, and limit your oral statement to no more than three minutes.  Matters that appear to warrant a more lengthy presentation or Council consideration will be agendized for further discussion at a later meeting.

 CONSENT CALENDAR
The Consent Calendar consists of items that the City Council considers to be non-controversial.  Unless any item is specifically removed by any member of the City Council, staff, or audience, the Consent Calendar will be adopted by one motion.  Items removed will be considered in the sequence as they appear below.  If any member of the audience wishes to have an item removed, please step to the microphone, state your name, and indicate the item.

The Consent Calendar was unanimously approved in one motion:

4.     Approve minutes of the following meetings of the City Council:
        A.     November 8, 2017, special.- minutes approved.
        B.     November 13, 2017, regular. - minutes approved.

5.    
Approve warrants of November 2017. - warrants approved.

6.    
Accept annual audit for the City of Belvedere. - Audit accepted.

7.    
Adopt two resolutions: (1) designating signatories for the City of Belvedere’s Westamerica Bank Operating & Payroll Accounts and authorizing transfers from one account to the other; and (2) designating signatories for the City of Belvedere’s WestAmerica Bank Line of Credit of $800,000. - Resolutions adopted.

8.    
Approve revocable license for private improvements in the public right-of-way in front of 298 Bella Vista Avenue. Barton F. Hoey. - Revocable license approved.

9.   
Approve revocable license for private improvements in the public right-of-way in front of 17 West Shore Road. Property Owner: Jennifer F. Fearon.
- Revocable license approved.


PUBLIC HEARINGS

10.    Introduction and adoption of an urgency ordinance amending Title 19, “Zoning,” of the Belvedere Municipal Code regarding marijuana regulations and introduction and first reading of an ordinance amending Title 19, “Zoning,” of the Belvedere Municipal Code by adding a new Chapter 19.93 “Marijuana Regulation.”
Staff recommendation: That t
he City Council conduct the public hearing and discuss the proposed ordinance amendments and, upon conclusion by not less than four-fifths vote, enact the proposed urgency ordinance regulating marijuana; and that the City Council conduct the public hearing and discuss the proposed ordinance amendments and, upon conclusion, approve the first reading and waive future reading of the ordinance regarding marijuana regulations.

The City Council adopted an urgency ordinance regulating marijuana and allowing recreational delivery (Attachment 3A) (McCaskill opposed) and approved the introduction and first reading of an ordinance regulating marijuana and allowing recreational delivery (Attachment 3B) (McCaskill opposed).

OTHER SCHEDULED ITEMS

11.    Consider requests for extension of Construction Time Limits and Construction Time Limit penalty appeals due to the North Bay fires.
Staff recommendation: Hear public comment, discuss, an
d give direction to staff regarding Construction Time Limit (CTL) extension applications and CTL penalty appeals for delays due to the North Bay Fires.

The City Council directed staff to return at a future meeting with an urgency ordinance amending the Construction Time Limit regulations to offer relief for construction projects affected by the North Bay fires.

12.   
Consider request to form a utility undergrounding assessment district on Golden Gate Avenue, Belvedere Avenue, and Cliff Road and adopt a resolution of intention to that end and a resolution authorizing a budget amendment for the undergrounding design.
Staff recommendation: Adopt the resolution of intention to
create the Golden Gate/Belvedere Utility Undergrounding Assessment District and authorize a budget amendment for the design.

The City Council approved the resolution of intention to create the Golden Gate/Belvedere Utlity Undergrounding Assessment District (McCaskill abstained and McAuliffe recused) and approved a resolution authorizing a budget amendment for the design of the district (McAuliffe recused).

13.   
Consider request from 222 Beach Road for a deed amendment allowing reconstruction of their residence if destroyed by fire or other natural disaster.
Staff recommendation: Review the record, conside
r public comment, and give direction to staff regarding requested deed amendment to allow reconstruction of the residence at 222 Beach Road if destroyed by fire or other natural disaster.

The City Council continued this item to a future meeting in order to gather more information on the property and the proposed request (McAuliffe recused).

14.   
Committee appointment to various City committees and commissions.
Staff recommendation: Make appointments to various City committees and commissions.

The City Council unanimously appointed Diana Bradley to be the Belvedere Representative to the Marin County Commission on Aging.

15.    Approve decision of Citizen of the Year Committee.
Staff recommendation: Approve the decision.
The City Council unanimously approved the decision of the Citizen of the Year Committee.
