The meeting was called to order at 6:30 P.M.

Council Absent: Winter

Vice Mayor McCaskill announced that the closed session had been cancelled.


 OPEN FORUM
This is an opportunity for any citizen to briefly address the City Council on any matter that does not appear in this agenda.  Upon being recognized by the Mayor, please state your name, address, and limit your oral statement to no more than three minutes.  Matters that appear to warrant a more lengthy presentation or Council consideration will be agendized for further discussion at a later meeting.
No one wished to speak.

REPORTS & PRESENTATIONS

2.     City Council Reports.
Council Member Campbell provided a report.

3.     City Manager Reports.
City Manager Middleton provided a report.

4.     Presentation by Police Chief Seyler on the Belvedere Block Captain disaster preparedness program and new Block Captains website.
Chief Seyler discussed the Belvedere Block Captain program and encouraged residents to sign up at belvederecaptains.org.

 CONSENT CALENDAR
The Consent Calendar consists of items that the City Council considers to be non-controversial.  Unless any item is specifically removed by any member of the City Council, staff, or audience, the Consent Calendar will be adopted by one motion.  Items removed will be considered in the sequence as they appear below.  If any member of the audience wishes to have an item removed, please step to the microphone, state your name, and indicate the item.

The Consent Calendar was approved in one motion:

5.     Approve minutes of the December 11, 2017, regular City Council meeting. - minutes approved.

6.     Approve warrants of December 2017. - warrants approved.

7.     Adoption of an ordinance of the City of Belvedere amending Title 19, “Zoning,” of the Belvedere Municipal Code regarding marijuana regulations. - ordinance adopted.

8.    
Adopt two resolutions of the City Council of the City of Belvedere: 1) Calling for a consolidated election to be held in its jurisdiction on June 5, 2018, to fill two expiring terms on the City Council; 2) Setting filing deadlines and adopting miscellaneous procedures relating to the conduct of the general municipal election to be held on June 5, 2018. - resolutions adopted.

9.    
Approve revocable license for private improvements in the public right-of-way in front of 330 Beach Road. Property Owner: Mai Dolch Revocable Trust Dated August 30, 2008.

PUBLIC HEARINGS

10.    Two appeals of a Planning Commission decision made on October 21, 2017, to approve retroactive design review for the lower floor walls at the east elevation for the property located at 2 Fern Avenue. Appellants: Geoffrey & Marine Strage/Tom & Angie Graf and Marcia McGovern & David Stoller. Property Owners: Gerry & Suzanne Morgan.
Staff recommendation: That the City Council conduct the public heari
ng and deny the joint appeal of Geoffrey & Marine Strage and Tom & Angie Graf, deny the appeal of Marcia McGovern & David Stoller, and uphold the Planning Commission decision approving retroactive design review for the subject lower floor walls.

The City Council held the public hearing and adopted a resolution denying both appeals and upholding the decision of the Planning Commission approving retroactive design review for the subject lower floor walls.

11.    Introduction and first reading of an ordinance amending Chapter 9.54, “Social Host Accountability,” of the Belvedere Municipal Code, which amendments include adding events with marijuana and controlled substances as unlawful youth gatherings; penalties for underage hosts of unlawful gatherings; and adding a restorative justice option for youth violators.
Staff recommendation: Cond
uct the public hearing and approve the introduction of the ordinance.

City Council conducted the public hearing and approved the introduction and first reading of an ordinance amending Belvedere Municipal Code Chapter 9.54, Social Host Accountability.

12.    Introduction and first reading of an ordinance amending Title 19, Zoning, of the Belvedere Municipal Code regarding Accessory Dwelling Units (ADU) to bring the Code into compliance with recent State Law changes effective October 2017, including no ADU parking requirement if unit is in a proposed or existing primary or accessory structure; no additional setback requirements if portion of an existing garage is made into an ADU; requirement of one parking space per unit or bedroom, whichever is less; and adding State Law definition of “tandem parking.”
Staff recommendation: Conduct the public hearing and approve the introduction of the ordinance.
City Council conducted the public hearing and approved the first reading and introduction of the Accessory Dwelling Unit ordinance amendments.

13.   
Introduction and adoption of an urgency ordinance amending Belvedere Municipal Code, Section 20.04.035, Time limits for construction. These amendments may include authorizing the City Manager and the Director of Planning & Building to administratively grant construction time limit extensions of up to eight (8) weeks, and relief from construction time limit penalties, upon the request of the applicant if the City Manager and Director of Planning & Building determine in their discretion that the construction delay was due to the North Bay Fires, for building permits active in October and November, 2017.
Staff recommendation: Conduct the public hearing and adopt the urgency ordinance.

City Council conducted the public hearing and approved the adoption of a Construction Time Limit urgency ordinance due to the North Bay Fires.
