BELVEDERE PLANNING COMMISSION

REGULAR MEETING AGENDA

MARCH 18, 2008, 6:30 P.M.

HEARING PROCEDURE:

The Planning Commission will follow the following procedure for all items listed as public hearing items:

1)      The Chairman will ask for presentation of the staff report;

2)      The Commission will have the opportunity to question staff in order to clarify any specific points;

3)      The applicant and the project representative will be allowed to make a presentation, not to exceed 10 minutes for large projects, or 5 minutes for small projects, total for the applicant’s design team;

4)      The public hearing will be opened;

5)      Members of the audience in favor of the proposal will be allowed to speak, for a maximum of 3 minutes per speaker;

6)      Members of the audience against the proposal will be allowed to speak, for a maximum of 3 minutes per speaker;

7)      The applicant will be given an opportunity to respond to comments made by the audience, for a maximum of 5 minutes total for the applicant’s design team;

8)      The public hearing will be closed; and

9)      Discussion of the proposal will return to the Commission with formal action taken to approve, conditionally approve, deny, or continue review of the application.

This is an opportunity for any citizen to briefly address the Planning Commission on any matter that does not appear on this agenda.  Upon being recognized by the Chair, please state your name, address, and limit your oral statement to no more than three minutes.  Matters that appear to warrant a more lengthy presentation or Commission consideration will be agendized for further discussion at a later meeting.

 

C.           CONSENT CALENDAR

The Consent Calendar consists of items that the Planning Commission considers to be non-controversial.  Unless any item is specifically removed by any member of the Planning Commission, staff, or audience, the Consent Calendar will be adopted by one motion.  Items removed will be considered in the sequence as they appear below.  If any member of the audience wishes to have an item removed, please step to the microphone, state your name, and indicate the item.

1.      Draft Minutes of the February 19, 2008 Regular Meeting of the Planning Commission.

D.            PUBLIC HEARINGS

2.      Conditional Use Permit for temporary childcare center use, including approximately 45 students and 10 staff members, at St. Stephen’s Church, 3 Bayview Avenue. CEQA status: categorically exempt pursuant to Section 15301. Property Owner: St. Stephen’s Church. Applicants: St. Stephen’s Church and Belvedere-Tiburon Child Care Center.

3.      Design Review, Exception To Total Floor Area, Variance, Lot Merger, and Revocable License for construction of a 10,281-square-foot residence at 425 Belvedere Avenue, including pool house, pool, garage, and landscaping features. Variance includes nonconforming maximum height.  CEQA status: categorically exempt pursuant to Section 15303.  Property Owner: 425 Belvedere Corporation. Applicant:  Walker & Moody Architects.

4.      Demolition Permit, Design Review, and Revocable Licenses for demolition of an existing residence and construction of a new 4,850-square-foot residence, including guest wing, retaining walls, fences, pool, and landscaping at 18 Eucalyptus Road. Proposal includes removal of 16-inch-diameter oak tree and 19-inch-diameter double trunk oak tree, as well as large cypress, fir, and eucalyptus trees, as well as grading and new retaining walls at Belvedere Avenue frontage. CEQA status: categorically exempt pursuant to Section 15303. Property Owners: Steve and Pamela Pasquan. Applicant: Ronald W. Wager, Walter & Wager Architects.

5.      Design Review, Variances and Exception to Total Floor Area for remodel and construction of an 869-square-foot garage and 151-square-foot addition at 50 Cliff Road, including modifications to existing floor plan.  Variances are for encroachments into the front yard setback. CEQA status: categorically exempt pursuant to Section 15301.  Property Owners: R.S. Pratt Revocable Trust and J.M. Brown Revocable Trust. Applicant: Russell Pratt.

6.      Demolition, Design Review, Exception to Total Floor Area, and Revocable License to remove existing home at 41 West Shore Road and construct a new 4,200-square-foot residence, spa, pool, second-story deck, 6-foot-tall stucco wall, and landscape improvements. CEQA status: categorically exempt pursuant to Section 15303. Property Owners: Krish Krishnan. Applicant: Holscher Architecture.

7.      CEQA Negative Declaration, Design Review and Use Permit to construct a new floating dock, gangway and boatlift accessed by an existing dock (to remain) in public open space adjacent to 43 West Shore Road. The floating dock would measure generally 11 feet by 22 feet and utilize an existing anchor piling.  The project would also remove a wood piling. A new gangway and landing would add additional new fill measuring generally 15 feet by 2.5 feet. Project would add two pilings to support a new boatlift on the existing dock. No grading or dredging is proposed as part of the project. CEQA status: proposed Negative Declaration.  Property Owner: Peter Gerwe.  Applicant: Paul Bergeron.

E. ADJOURNMENT

APPEALS: The Belvedere Municipal Code provides that the applicant or any interested person may appeal the action of the Planning Commission on any application.  The appeal must be in writing and submitted with a fee of $400.00 not later than seven (7) calendar days following the date of the Planning Commission action. Please note that if you challenge in court any of the matters described above, you may be limited to raising only those issues you or someone else raised at the public hearing described above, or in written correspondence delivered to the Planning Commission at, or prior to, the above- referenced public hearing [Government Code Section 65009(b)(2)].
