NOTICE IS HEREBY GIVEN that on Tuesday, June 20, 2017 at 6:30 p.m., the Planning Commission of the City of Belvedere will hold a regular meeting at 450 San Rafael Avenue, Belvedere, California, to consider actions and reports including the following:

1. Design Review, Exception to Total Floor Area, Variance and Revocable License applications for a remodel and addition to an existing single family home at 296 Beach Road. On February 14, 2011 the City Council designated the property a City of Belvedere Historic Property. A 432 Square foot addition is proposed in the dwelling which includes a new entry, kitchen addition and a mechanical room expansion. The detached garage is proposed to be raised four feet to make it more accessible and 389 square foot expansion of the garage on the lower level to create a guest unit. The project proposal requires an Exception to Total Floor Area to exceed the maximum allowable floor area, 4,850 SF is permitted and 6,634 SF is proposed. The Variance is required because the project proposes to encroach into the side yard setback. Improvements are also proposed in the Revocable License area. 2. Design Review, Variance and Exception to Total Floor Area applications for a remodel, addition and landscape modifications to an existing single family home located at 30 Windward Road. The project includes removing the existing entry, and adding on to the first floor of the home at the dining room, breakfast nook and garage. The Variance is required because the proposed roof overhang will encroach into the rear yard setback, the required setback is 15 feet and the proposed over hang is 11 feet. New landscaping, hardscape and lighting is proposed in the rear and side yards. The project proposal requires an Exception to Total Floor Area to exceed the maximum allowable floor area, 4,000 SF is permitted and 4,083 SF is proposed. Applicant: Hank Bruce Architects. 3. Design Review, Exception to Total Floor Area, and Revocable License applications for a 901 square foot second story addition above the garage and four small additions in the dwelling totaling 133 square feet located at 12 Britton Avenue. The proposed project will maintain the stucco siding, the new and replaced windows will be in steel. The project proposed a new metal roof. Applicant: Sutton Suzuki Architects. Owner: Jason and Claire Zintak.

4. Design Review and Variance applications for a new fence located at 36 Cove Road. The fence is proposed on the North property line and is proposed between 6 feet and 10 feet in height. Applicant: Pedersen Associates. Property Owner: Robert and Connie Peirce.

5. Demolition Permit, Architectural & Environmental Design Review, Exception to Floor Area, Second Unit Permit, Variance(s), Use Permit, Revocable License, Request for 24-Month Construction Time Limit and Lot Merger applications for 135 Belvedere Avenue (APN 060-181-06, 07 & 08). The project proposes demolition of existing structures on the property including an existing single family home, detached garage, water tank (currently empty and not connected to well) to make way for construction of a new two-story, 10,340 square-foot, single family residence with attached 1,250 square-foot, 5-car garage, a 750 square-foot accessory (second) dwelling unit; and other improvements including a hillavator, a 128-square-foot boat storage structure, and a fixed pier (875 square feet) that would extend seaward into Richardson Bay on a tide lot owned by County of Marin. Installation of a platform lift (96 square feet) and boat lift (12 square feet) is also proposed. New retaining walls, auto court, guest parking, landscaping, terraces, pool, stairway to shoreline, bioretention and drainage management areas are also proposed as part of the project. Total lot size would be 53,978 square feet (1.24 acres) based on proposal to merge three lots into one single lot. An exception to total floor area is requested for exceeding the allowed per the Municipal Code and Variances are requested for the Second Unit for exceeding the required height limit and for the property exceeding the applicable floor area on which the Second Unit is located (Belvedere Municipal Code Sections 19.78.070 E and Section 19.78.070 C). The applicant is also requesting a 24-month Construction Time Limit and a Use Permit for private recreational in the R-Recreational Zone. A Revocable License is required for improvements in the city right-of-way. Applicant: David Kotzebue Architecture. Owner: Amalfi 135 Belvedere, LLC.

6. Consideration of proposed amendments to the Belvedere Municipal Code, including amendments to Title 19, Zoning, regarding Accessory Dwelling Units and Junior Accessory Dwelling Units. The purpose of said amendments is to bring the Belvedere Municipal Code into compliance with recent amendments to State law.

7. Extension request of previous approvals granted for Design Review, Variance, and Exception to Total Floor Area for the property located at 285 Bayview Avenue to allow construction of various improvements to the residence, including construction of a new entry on the rear elevation of the residence, creation of a new roof deck and installation of a new gas fireplace on an existing roof deck, as well as the construction of other site improvements, including the replacement if existing retaining walls, and the construction of new retaining walls, in the front, side and rear yards. NOTICE IS HEREBY FURTHER GIVEN that at the above time and place, all letters received will be noted, and all interested parties will be heard. Please note that if you challenge in court any of the matters described above, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the Planning Commission at, or prior to, the above-referenced public hearing [Government Code Section 65009(b)(2)]. Correspondence will be received up to the start of the meeting. Please submit any correspondence by June 12, 2017, for inclusion in the staff report distributed to the Commission before the meeting. Items will not necessarily be heard in the above order or, because of possible changes or extenuating conditions, be on the actual agenda.
