[ARCHIVED] Notice of Availability and Intent to Adopt a Negative Declaration - October 18, 2013

The City of Belvedere is the Lead Agency and has prepared an Initial Study and Negative Declaration for the project identified below. Regional and state agencies will use the Negative Declaration prepared by our agency when considering permit or other approvals for the project. Adoption of the Negative Declaration and consideration of project applications are scheduled before the City of Belvedere Planning Commission on November 19. 2013, at 6:30 p.m. The public review period will last from 9 a.m. October 18, 2013 to 4:30 p.m. November 18, 2013.
Project Description: The proposed project consists of a Planned Unit Development (PUD) overlay for seven (7) existing lots located along Lower Beach Road and the subdivision of five (5) of the seven (7) lots into 20 parcels (sub lots). The subdivision portion of the project contains a total of 72 existing residential units and 4,500 square feet of commercial space. An additional 25 residential dwelling units occupy the lots that are proposed for the PUD, but are not part of the subdivision. The proposed PUD Overlay Zone would establish the existing development, such that no additional development potential beyond what is currently allowed per the underlying zoning would be realized. Pursuant to Section 19.87.010 of the Belvedere Municipal Code, a PUD requires the inclusion of a public benefit aspect. At the September 9th, 2013 Study Session, the City Council determined that the public benefit would be a $50,000 contribution towards construction of ADA compliant sidewalks along an approximately 100 foot stretch of San Rafael Avenue, north of Beach Road and 6 curb cuts within the project area (see figure 3). The project would retain existing development already established and no additional construction or re-development, other than the sidewalk improvements, is proposed.

Finding: Based on the entire record of proceedings for the proposed project, including but not limited to the information and analysis contained in the Initial Study and Negative Declaration and the comments received by the City thereon. The City hereby finds that there is no substantial evidence in the record that the project could have a significant effect on the environment. This finding is based upon the criteria of the Guidelines of the State Secretary for Resources, Sections 15064 (Determining Significant Effect), 15065 (Mandatory Findings of Significance), and 15070 (Decision to prepare a Negative Declaration), and the following reasons as documented in the Initial Study and Negative Declaration.

The Initial Study and Negative Declaration were prepared under the supervision of the City, which exercised overall control and direction of the City’s compliance with all requirements of the California Environmental Quality Act. The City has independently reviewed the Initial Study and Negative Declaration, which reflect the City’s independent judgment and analysis.

The record of proceeding for the proposed project, including but not limited to the Initial Study used to make the above determinations and findings, and all comments received thereon, is on file and available during regular business hours at the Planning Department, 450 San Rafael Avenue, Belvedere, CA 94920-2336. A copy of the Negative Declaration is available at the City Hall at 450 San Rafael Avenue, Belvedere from 9 a.m. to 4:30 p.m., Monday to Thursday. City offices are closed from 12 p.m. to 1 p.m. Due to the time limits mandated by State law, your response must be sent at the earliest possible date but not later than November 18, 2013.
