NOTICE IS HEREBY GIVEN that on Tuesday, April 17, 2018 at 6:30 p.m., the Planning Commission of the City of Belvedere will hold a regular meeting at 450 San Rafael Avenue, Belvedere, California, to consider actions and reports including the following:

1. Design Review and Exception to Floor Area applications for 40 Bayview Avenue. The project proposes to convert an existing carport into an enclosed garage. The project requires an exception to Total Floor Area; the allowed floor area is 2,739 SF and the project proposes 3,798 SF and 3,735 SF exists. Applicant: Tim Hachman, Hachman Construction; Property Owner: Carlos & Stephanie Vasquez.

2. Consideration of an ordinance amending Chapter 20.04.035, the “Construction Time Limit Ordinance”, of the Belvedere Municipal Code, which amendments include: application of construction time limits for all projects requiring Design Review and/or requiring a building permit valuing $50,000 or greater; expanded authority of building official to request project valuation documentation; ability of applicants for 18-month projects to request extension at time of Design Review hearing; courtesy neighbor notice of construction time limit extensions; clarification of factors evaluated when granting a time limit extension and appeal of construction time limit penalty; and clean-up ordinance changes.

3. Consideration of proposed amendments to the Belvedere Municipal Code, including amendments to Title 19 and Title 20, regarding Fence Regulations as recommended by the Deer Fence Task Force Committee. The Deer Fence Task Force Committee was formed to consider reducing the impact of deer on the City of Belvedere, which included suggestions for deer resistant landscaping and appropriate fences to deter deer from entering properties, while also maintaining the aesthetic character of the community and preventing a “walled” effect due to fences.

4. Consideration of proposed amendments to the City of Belvedere Administrative Policy Chapter 272 Revocable Licenses related to the issuance of revocable licenses for City property, including private improvements on public property and City public lanes. The purpose is said amendments is to provide for additional clarifying language and or criteria to consider when reviewing Revocable Licenses and propose improvements on City property.

5. Consideration of approval of the Construction Time Limit (CTL) extension request for the proposed project at 135 Belvedere Ave., APN # 60-181-07. This project includes the demolition of an existing single family dwelling (SFD) and associated support structures the aforementioned address. Two neighboring parcels, APN #’s 60-181-06 and 60-181-08, will then be combined with the parcel at 135 Belvedere Ave. and a new SFD, 10,340sf; second unit, 750sf; garage, 1,250sf; boathouse and a boat dock/pier will be constructed. In addition to these structures, site improvements are proposed that include, but are not limited to, the construction of an in-ground swimming pool, installation of a hillavator, stairways, retaining walls, and other landscaping features. The applicant has submitted a request for a six (6) month extension of the 18 month CTL timeline as set forth by City of Belvedere Municipal Code (BMC) section 20.04.035:D1. NOTICE IS HEREBY FURTHER GIVEN that at the above time and place, all letters received will be noted, and all interested parties will be heard. Please note that if you challenge in court any of the matters described above, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the Planning Commission at, or prior to, the above-referenced public hearing [Government Code Section 65009(b)(2)]. Correspondence will be received up to the start of the meeting. Please submit any correspondence by April 10, 2018 for inclusion in the staff report distributed to the Commission before the meeting. Items will not necessarily be heard in the above order or, because of possible changes or extenuating conditions, be on the actual agenda.
