1. Retroactive Design Review and Variance applications for a new deck with a height exceeding the maximum allowable height of four feet above grade in the required rear yard of the existing residence at 15 Toyon Avenue. CEQA status: categorically exempt pursuant to Section 15301, Existing Facilities. Property Owners: Andrew Ashcroft, Reza and Afseneh Zolfighari. Applicant: Hau-Ching Liao.

2. Design Review and Exception to Total Floor Area for a new 495-square-foot pool house with a new pool equipment enclosure and expansion of an existing trellis located at 1 Britton Avenue. CEQA status: Categorically exempt pursuant to Section 15303, New construction or Conversion of Small Structures. Property Owners: Noelle Montgomery & Dan Janney. Applicant: Hank Bruce Architects.

3. Study Session to consider possible amendments to Title 19 of the Belvedere Municipal Code to redefine height as measured from the baseline flood elevation for properties within the R-1L, R-2 and R-3 Zoning Districts within flood plain areas as drawn by the 2009 Flood Insurance Rate Maps (FIRM) prepared by FEMA and the U.S. Department of Homeland Security. CEQA status: unknown. Applicant: City of Belvedere. Property Owners: Citywide.
NOTICE IS HEREBY FURTHER GIVEN that at the above time and place, all letters received will be noted, and all interested parties will be heard. Please note that if you challenge in court any of the matters described above, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the Planning Commission at, or prior to, the above-referenced public hearing [Government Code Section 65009(b)(2)]. Correspondence will be received up to the start of the meeting. Please submit any correspondence by February 6, 2013 for inclusion in the staff report distributed to the Commission before the meeting. Items will not necessarily be heard in the above order or, because of possible changes or extenuating conditions, be on the actual agenda. For additional information, please contact City Hall.
